The Limited Designs License sold through ResDes.com is protected by The
United States Copyright Act. Reproduction of these Designs, either in
whole or in part, including any form of copying, distribution,
dissemination, preparation, of derivative works there from, for any
reason without prior written permission, is strictly prohibited. The
purchase of a License in no way transfers any copyright or other
ownership interest in it to the buyer except for a limited license to
use that Design for the construction of one Structure.
The purchase of the Limited Designs License via reproducible media
(Electronic, Paper, or CAD files) carries the same copyright protection
as stated above. Making any type of copies from our Originals
(Electronic, Paper, or CAD files) is illegal. If additional sets
are required, please contact ResDes.com to purchase additional sets at a
nominal cost (for the same site only). Printers are prohibited from
making copies of these Designs.
Plans may not be redrawn or modified
without first obtaining the ResDes.com written permission. If you
need to make major changes or need to have the plans redrawn for any
reason you may contact ResDes.com for modification services.
Reproducible plans come with a license to copy, as well as to make
modifications to the plans, for the Purchasers own use. Once modified,
the plans can be printed for the construction of one Structure only.
This license does not include the right to sell or distribute copies to
others.
With a license to make
modifications to a copyrighted design, the modified design is not free
from the original designer's copyright. This is considered derivative
work. The sale or reuse of the modified design is prohibited. Also, be
aware that any modification to the Design voids all warranties
expressed or implied.
Copyright and licensing of Designs for construction exists to protect
all parties. It respects and supports the intellectual property of the
original designer.
Penalties for violating copyright may be severe. Any party who
participates in copyright violation may be responsible, including the
purchaser, designers, architects, engineers, drafters, homeowners,
builders, contractors, subcontractors, printers, developers and real
estate agencies. The responsible parties are required to pay
actual damages caused by the infringement (which may be substantial),
plus any profits made by the party violating the law. The copyright law
also allows for recovery of statutory damages, which may be as high as
$150,000 for each infringement. Finally, the party violating the law may
be required to pay legal fees, which often exceed the damages.
